Disinherited Loved One

The Wills Estates and Succession Act (WESA) may permit spouses and children who have either been left out of a will, or not adequately provided for under the will, to seek a court order to vary the Will.

Upon receiving a Notice of Probate, carefully review the document to understand your interest in the estate and any deadlines for action. Consult an estate lawyer to evaluate your position and consider filing a Notice of Objection if you have concerns about the will’s validity or the executor’s suitability. There are extremely short timelines for you to vary or correct a will.

“Unfair distribution” refers to a situation where an estate’s assets are allocated in a manner that may seem unjust or inequitable to certain parties. Governing legislation, specifically the Wills, Estates and Succession Act [SBC 2009] c. 13 (the “WESA”), allows the spouse and children of the testator to apply to alter a will after the testator dies. The definition of spouse is broad and inclusive.

Undue influence occurs when someone exerts excessive pressure on the testator (the person making the will) to alter the terms of the will in a way that benefits the influencer, often at the expense of other potential beneficiaries.

If you have contributed to the estate of a deceased and feel that the deceased’s will inadequately provides for you in light of your contributions to the estate, you can bring an action against the estate for compensation. We may be able to help you with this potential claim.

“Improper execution” refers to the failure to adhere to the legal formalities required for a valid will. Each jurisdiction has specific rules governing how a will must be executed (i.e., signed and witnessed) to be considered legally binding. If these requirements are not met, the will may be deemed invalid, which can lead to the estate being distributed according to intestacy laws or a previously valid will. We see this issue more frequently in recent years given the rising number of people using “do it yourself” will kits without the assistance of a lawyer.
