Unlike a missed train, a missed time deadline for an ICBC injury claim does not give you another chance. Your claim will likely be lost forever. Some deadlines occur within days, hours or two years from the date of your car or pedestrian accident. Here are just a few examples of important time limits that must be followed by you if you’ve been injured in a car accident:
1. The TWO YEAR LIMITATION Date
You must file a lawsuit in a British Columbia court before the expiry of two years from the date of your accident injury. If you don’t do this your entire injury claim will be gone. You do not have to settle within two years, but you absolutely must file the lawsuit documentation (good law firms like Dyson Law can help you with this) within two years. There are very few exceptions to this rule. If you are under the age of 19, your injury claim two year time limit against the offending driver will be suspended until you turn 19. This is not true for ICBC benefits. You must sue ICBC within two years for a benefit claim even if you are under the age of 19.
2. The TWO MONTH Local Government Claim Date.
You must file within two months of the date of your injury a warning letter with the Clerk of a Local Government if your injury claim was caused by a local government such as a city or town. An example would be if you were struck down and injured in a crosswalk by a city garbage truck.
3. Hit and Run Motorist Injury Claims
If you were injured by a hit and run motorist, you must immediately (as in right away) take steps to identify the motorist who injured you. This means phoning the police, getting the license plate of the other vehicle and identifying witnesses. Classified ads should be published. Furthermore, a written notarized report must be filed with ICBC within six months of the date of the accident.
